| Abstract | Given the large number of subjects of administrative regulation of construction in Ukraine, the article emphasizes the need to determine the administrative and legal status of the Ministry of Regional Development, Construction and Housing and Communal Services of Ukraine, whose main task is to coordinate the implementation of construction activities in our state. In view of this need, the tasks, functions and powers of this state body of executive power of Ukraine have been investigated. The purpose of the article is to determine and analyze the administrative and legal status of the entity implementing the normalization in construction – Ministry of Regional Development, Construction and Housing and Communal Services of Ukraine. The competence of the Ministry is outlined and the following elements are highlighted: the obligation to the state to perform certain tasks and functions; the right of managed objects to perform certain tasks and functions; the right to perform management activities in the forms prescribed by the normative legal acts of Ukraine. It has been found that competences, which are generally defined as a set of rights and responsibilities, are a major component of competence. The following groups of powers of the Ministry of Regional Development are identified, which are its components of competence: 1) organizational powers; 2) normative-making powers; 3) control powers. The definition of the concept of “authority”, the problem of identification and separation of powers as a separate legal category and a set of other rights and duties are considered. It is established that the constituent elements of the administrative and legal status of the executive authority can also be attributed to: purpose, tasks, functions, responsibilities. It is noted that the current legislation does not clearly state the purpose of the Ministry of Regional Development, Construction and Housing and Communal Services of Ukraine. It is emphasized that understanding of the definition and content of the administrative-legal status of the executive authority makes it possible to distinguish it from other state bodies, defining the peculiarities of its organization, functioning and interaction with other state authorities. It is concluded that the administrative and legal status of the Ministry of Regional Development, Construction and Housing and Communal Services of Ukraine is governed by the norms of administrative law, fixed at the legislative level set of tasks, rights and responsibilities (powers) that characterizes the Ministry as an executive body, which manages construction, architecture, town planning, housing and communal services. |
